Who you are contracting with

The Bloat Clarity System is sold by Dwayne Fermor of KoopNet (Pty) Ltd, South Africa (the seller). By purchasing or using the product you enter into an agreement with the seller and accept these terms.

Acceptance

By continuing to use this site or the product, you confirm that you accept these terms. If you do not accept them, please do not purchase or use the product. You confirm that you are of legal age to make this purchase, or that you have authority to bind the organisation you represent.

What the product is

The product is a digital, one-time purchase of US$29 consisting of The Bloat Clarity System book, Your Clarity Workbook as a fillable and printable PDF, and access to the web based Clarity Tracker through a private link. The tracker includes daily check-ins, week views, your own reports, a personal plan builder and a one-page summary you can share with a clinician.

The tracker is used without an account or password. Access is tied to the private link issued with your purchase, so keeping that link private is your responsibility. Tracker entries are health related and are handled as described in the Privacy Notice. You can delete all of your tracker entries at any time from inside the tracker.

The product does not diagnose any condition, does not prove a food intolerance, does not identify definitive trigger foods, does not promise relief and does not prescribe a therapeutic diet. It is not for use by people under 18, and it is not suitable during pregnancy or where there is a current or past eating disorder, or where red flag symptoms are present. Do not change prescribed medication because of anything in this product.

The product provides general educational information and a structure for self observation. It is not medical advice, diagnosis or treatment, it does not replace care from a qualified healthcare professional, and it makes no promise of any specific health outcome. Speak with a qualified healthcare professional about your symptoms and before changing how you eat.

Licence and permitted use

You receive a limited, non-exclusive, non-transferable right to use the product for your own personal use. You may print copies for your own use.

You must not resell, redistribute, publish, share publicly, sublicense or create derivative commercial works from the product, and you must not remove any notices from it.

Misuse

You must not use this site or the product to:

• break any applicable law or regulation,
• commit fraud, send spam or impersonate another person,
• infringe intellectual property or other rights of any person,
• interfere with the security or operation of the site, including malware, probing, scraping or attempts to bypass technical limits, or
• share paid download links or files with people who have not purchased.

Intellectual property

The seller retains ownership of the product and all related intellectual property, including the documents, text, layout, illustrations and branding. Anything you write inside your own copy of the workbook remains yours.

Access, availability and service level

Access is provided through a private link that stays valid for 90 days. The seller aims to keep the site, the tracker and the download links working, but does not guarantee uninterrupted or error free availability.

Payment, billing, tax and cancellation

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Warranties and liability

To the fullest extent permitted by law, the seller disclaims implied warranties, including merchantability and fitness for a particular purpose. The seller is not liable for indirect, consequential or special damages, including loss of profits, data or goodwill.

To the fullest extent permitted by law, the seller's total liability is limited to the amount you paid for the product in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow such exclusion.

Suspension and termination

The seller may suspend or terminate your access to the product or the site for material breach of these terms, non-payment or a reversed payment, security or fraud risk, or repeated or serious policy violations. If access ends, you may keep files you have already downloaded for personal use, subject to the licence above.

Changes, governing law and disputes

These terms may be updated to reflect changes to the product or the law, and the updated version applies to purchases made after it is published.

These terms are governed by the laws of the seller's place of establishment, and disputes are subject to the courts of that jurisdiction, without affecting consumer rights you have where you live.
