Who is responsible for your data

Dwayne Fermor (the seller) is the data controller for personal data collected through this site and through the sale of The Bloat Clarity System. You can reach us at support@buyfermor.com.

What we collect and why

• Order and contact data, such as your email address, order identifier, product purchased and purchase date. We use this to deliver your download link, recognise your purchase and handle support requests. Legal basis: performance of our contract with you.
• Support messages you send us. We use these to answer your question. Legal basis: performance of our contract and our legitimate interest in providing support.
• Technical and security data, such as IP address, device and browser information and server logs, including download activity on your private link. We use this to keep the site and paid files secure and to prevent abuse. Legal basis: our legitimate interest in security and fraud prevention.

Clarity Tracker entries, if you choose to use the tracker. These are health related and therefore sensitive. They include a bloating score from 0 to 10, rough timing and meal notes, broad food categories, bowel movement notes, habit answers such as fizzy drinks or eating quickly, rough sleep, a stress level, optional cycle context, an optional free text note about anything unusual, the conservative experiment you choose in Phase 2, and the plan text you write in Phase 3. We use this only to run your tracker and generate your own reports. Legal basis: your explicit consent, which you give on the acknowledgement screen before anything is stored, and which you can withdraw at any time by deleting your tracker data.

We do not ask for calories, grams, macros, weight or body measurements, and the tracker does not collect them. Anything you write inside your own downloaded copy of the workbook stays with you and is never sent to us.

Tracker entries are linked to an internal order identifier rather than to a named account. Symptom information is never placed in a web address, never included in an ordinary email or a marketing email, and never sold or shared for advertising. No advertising or third-party analytics scripts run on tracker pages.

Payment card details are collected and processed by our payment provider, not by us. We never see or store your card data.

Who we share data with

• Paddle.com, our reseller and Merchant of Record, for the sale of the product, payments, invoicing and tax compliance.
• Service providers acting on our behalf, such as hosting, database, file storage and email delivery providers.
• Professional advisers, such as legal and accounting advisers, where needed.
• Authorities, where we are required to share data by law.

International transfers

Our providers may process data outside your country, including outside the United Kingdom and the European Economic Area. Where that happens, transfers rely on appropriate safeguards such as standard contractual clauses or an adequacy decision.

How long we keep data

Order records are kept for as long as needed to support your purchase and to meet accounting and tax obligations. Private access links expire 90 days after purchase. Technical logs are kept for a short period for security purposes. When data is no longer needed it is deleted or anonymised.

Clarity Tracker entries are kept until you delete them. The tracker has a one-click delete that removes every daily entry, experiment and plan linked to your access link. Your order record is deliberately kept separate and is retained after that deletion, because it is needed for payment, refund and tax history. After deleting, you can start a fresh tracker on the same link while it is still valid.

Your rights

Depending on where you live, you may have the right to access your personal data, correct it, delete it, restrict or object to its processing, receive a portable copy and withdraw consent where processing is based on consent. To exercise any right, contact us at support@buyfermor.com and we will respond within one month.

If you are in the United Kingdom or the European Economic Area, you also have the right to complain to your local data protection supervisory authority.

Security

We use appropriate technical and organisational measures to protect personal data, including encryption in transit, access controls and private, time limited download links for paid files. Tracker records are reachable only by our server code acting on a valid access link, and direct database access to them is blocked.

This notice is written to reflect the principles of the UK and EU GDPR and of the South African Protection of Personal Information Act. It has not been reviewed by a lawyer and it is not a formal legal compliance opinion.

Cookies

This site runs no advertising or analytics tracking scripts. Only essential storage needed to load the page and complete a purchase through our payment provider is used, so no cookie consent banner is required. If we add analytics or marketing cookies in future, this notice will be updated and consent will be requested first.
